Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Jabalna platform (the "Service"), operated by Jabalna ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

Please also review our Privacy Policy, which describes how we collect, use, and protect your personal data.

1. Eligibility

To use the Service, you must:

  • Be at least 18 years of age.
  • Be a member of the Druze community. By creating an account, you attest that you are Druze. We reserve the right to verify this and to remove accounts that do not meet this requirement.
  • Have received a valid invitation from an existing member.
  • Not have been previously banned or removed from the Service.
  • Be legally able to enter into a binding agreement.

By creating an account, you represent and warrant that all of the above conditions are true. If we discover that any of these conditions are not met, we may suspend or terminate your account immediately.

2. Your Account

2.1 Registration

You must provide accurate, current, and complete information when creating your account. You must keep your account information up to date. You may not use another person's identity or create an account on behalf of someone else.

2.2 Security

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorised use of your account. We are not liable for any loss arising from unauthorised access to your account.

2.3 One Account Per Person

You may only create and maintain one account. Duplicate accounts may be removed without notice.

3. Invitations

The Service operates on an invitation-only basis. As a member, you may invite others to join. By sending an invitation, you confirm that:

  • The person you are inviting is, to the best of your knowledge, a member of the Druze community.
  • You have a genuine reason to believe they would benefit from and respect the Service.

Invitations expire after a limited period. We reserve the right to limit the number of invitations you may send and to revoke invitation privileges if they are misused.

4. Acceptable Use

You agree to use the Service respectfully and in accordance with its intended purpose as a dating platform for the Druze community. You must not:

4.1 Prohibited Conduct

  • Harass, bully, intimidate, threaten, or abuse any other user.
  • Send unsolicited, inappropriate, offensive, or sexually explicit messages or content.
  • Stalk or attempt to contact a user who has blocked you or asked you not to contact them.
  • Discriminate against or demean any person based on race, ethnicity, national origin, disability, or any other characteristic.
  • Impersonate another person or misrepresent your identity, age, or affiliation.
  • Use the Service for any commercial, promotional, or advertising purpose.
  • Solicit money or financial information from other users.
  • Share, post, or transmit any content that is illegal, fraudulent, defamatory, or infringes on the rights of others.
  • Use the Service to collect information about other users without their consent.

4.2 Prohibited Technical Activity

  • Attempt to gain unauthorised access to any part of the Service, other users' accounts, or our systems.
  • Use automated scripts, bots, scrapers, or other automated means to access or interact with the Service.
  • Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Circumvent or attempt to circumvent any security features, rate limits, or access controls.
  • Upload malicious code, viruses, or any harmful material.

5. Content

5.1 Your Content

You retain ownership of the content you submit to the Service, including your profile information, photos, questionnaire answers, and messages ("Your Content"). By submitting content, you grant us a limited, non-exclusive, royalty-free licence to use, store, display, and distribute Your Content solely for the purpose of operating and providing the Service. This licence ends when you delete Your Content or your account.

5.2 Content Standards

Your Content must be accurate and honest. You must not upload content that:

  • You do not have the right to share.
  • Is false, misleading, or deceptive.
  • Is sexually explicit, pornographic, or obscene.
  • Promotes violence, hatred, or illegal activity.
  • Infringes any intellectual property, privacy, or other rights of a third party.
  • Contains personal information of another person without their consent.

5.3 Content Moderation

We reserve the right, but are not obligated, to review, remove, or disable access to any content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable. We are not responsible for content posted by users.

6. Matching and Compatibility

The Service uses a mathematical algorithm to calculate compatibility scores between users based on questionnaire answers. These scores are provided as suggestions only and should not be relied upon as a guarantee of compatibility or relationship success. We make no representations or warranties about the suitability of any match.

All interactions with other users are at your own risk. We do not conduct criminal background checks or verify the identity, statements, or intentions of users beyond what is described in these Terms.

7. Safety and Reporting

7.1 Your Safety

You are solely responsible for your interactions with other users. We strongly recommend that you exercise caution, use good judgement, and follow standard safety practices when communicating with or meeting anyone through the Service. If you choose to meet someone in person, do so in a public place and inform a trusted person of your plans.

7.2 Reporting

If you experience or witness behaviour that violates these Terms or makes you feel unsafe, please report it immediately through the Service's reporting feature or by contacting us directly. We take all reports seriously and will investigate promptly. However, we cannot guarantee any specific outcome from a report.

7.3 Blocking

You may block any user at any time. Blocking a user will end any existing conversation between you and prevent future interaction. We will not disclose to the blocked user that they have been blocked.

8. Verification

We may offer optional identity verification. Verification indicates only that a user has submitted documentation that has been reviewed by our team. It does not constitute an endorsement, guarantee of identity, or assurance of trustworthiness. You should exercise your own judgement regardless of another user's verification status.

9. Intellectual Property

The Service, including its design, features, code, branding, logos, and all associated intellectual property, is owned by Jabalna and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent.

10. Suspension and Termination

10.1 By You

You may delete your account at any time through the Service. Upon deletion, your profile, photos, answers, messages, matches, and interaction records will be permanently destroyed in accordance with our Privacy Policy.

10.2 By Us

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe that:

  • You have violated these Terms.
  • Your account poses a safety or security risk to other users.
  • Your conduct is harmful to the Service, our community, or third parties.
  • You are not eligible to use the Service.
  • We are required to do so by law.

We will endeavour to provide an explanation for any suspension or termination where it is reasonable and legally appropriate to do so.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • The results obtained from the Service (including compatibility scores) will be accurate or reliable.
  • Any other user's profile information is accurate, truthful, or complete.
  • The Service will meet your expectations or requirements.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Jabalna and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from or related to:

  • Your use of or inability to use the Service.
  • Any conduct or content of any other user of the Service.
  • Unauthorised access to or alteration of your data or transmissions.
  • Any interactions, meetings, or relationships arising from the Service.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

For Australian consumers, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms is intended to modify or exclude those guarantees.

13. Indemnification

You agree to indemnify and hold harmless Jabalna and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to:

  • Your use of the Service.
  • Your Content.
  • Your violation of these Terms.
  • Your violation of any rights of another person.

14. Dispute Resolution

We encourage you to contact us first if you have a dispute, so that we can attempt to resolve it informally. If a dispute cannot be resolved informally within 30 days, the following applies:

  • These Terms are governed by the laws of New South Wales, Australia.
  • Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

Nothing in this section limits your right to bring proceedings in your local jurisdiction where mandatory consumer protection laws apply, including but not limited to the courts of EU member states for EU residents.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by displaying a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.

16. General Provisions

  • Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jabalna regarding your use of the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • No agency: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Jabalna.
